1 Parties and acceptance
These Terms are between [LEGAL ENTITY NAME], registration number [CIPC NUMBER], trading as StudeeHelpers (we, us or StudeeHelpers), and each person who accesses or uses the website, mobile application or related services (you). By creating an account, clicking acceptance or continuing to use the platform after lawful notice of a material update, you agree to these Terms. If you act for an organisation, you warrant that you have authority to bind it.
2 Platform role
StudeeHelpers provides technology, matching, booking, payment administration, verification status display and support. The legal role for a particular booking must be stated in the booking summary. Depending on the approved operating model, StudeeHelpers may act as marketplace intermediary, disclosed agent, or direct supplier. No wording in these Terms changes a relationship that the law classifies differently based on its substance.
3 Eligibility and accounts
- Users must be at least 18 and legally capable of contracting. Child care may be booked only by a parent, legal guardian or adult authorised by one.
- Registration information must be accurate, current and not misleading. One person may not impersonate another or create accounts to evade suspension.
- You are responsible for account security and must promptly report suspected compromise. StudeeHelpers may require identity or risk verification proportionate to the service.
4 Permitted use
The platform may be used only to request, accept, manage and pay for lawful household services. Users may not scrape data, reverse engineer, disrupt security, upload malware, harvest personal information, discriminate unlawfully, solicit off-platform bookings to avoid disclosed fees, misuse emergency channels, publish private information or use the platform for unlawful, abusive or exploitative conduct.
5 Listings availability and matching
Helper profiles, distance, availability, badges and estimates depend on supplied and system data. Approximate location does not represent a helper's home address. A search result is not a guarantee of acceptance, arrival time or availability. A booking becomes confirmed only when the platform records confirmation and any required payment authorisation.
6 Intellectual property
The platform, software, design, brand, databases and original content are owned by or licensed to StudeeHelpers. A limited, revocable, non-transferable licence is granted for personal use. Users retain ownership of their content but grant StudeeHelpers a non-exclusive licence to host, process and display it only as reasonably required to operate, secure and improve the services, subject to the Privacy Notice.
7 Reviews and user content
Reviews must describe genuine experiences and may not be defamatory, discriminatory, threatening, manipulated or disclose private information. StudeeHelpers may moderate content using published standards, preserve evidence and provide an appeal. Moderation does not make StudeeHelpers the author of user content.
8 Suspension and termination
StudeeHelpers may restrict or suspend access where reasonably necessary for safety, fraud prevention, legal compliance, material breach or investigation. Except where urgent protection or law prevents notice, we will provide a reason and a fair opportunity to respond. Accrued payment, confidentiality, privacy, dispute and liability provisions survive termination.
9 Third party services
Maps, messaging, identity checks and payments may be supplied by third parties under their terms. StudeeHelpers remains responsible for its own obligations and will not use third-party terms to exclude rights that cannot lawfully be excluded.
10 Liability and mandatory rights
Nothing excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, gross negligence where exclusion is prohibited, or rights under applicable consumer law. Subject to those limits, StudeeHelpers is not liable for indirect or consequential loss that was not reasonably foreseeable. Any monetary cap must be inserted only after attorney and insurer review and must be drawn conspicuously to the consumer's attention before acceptance: [APPROVED LIABILITY CAP].
11 Complaints disputes and governing law
Complaints must first be sent to [LEGAL EMAIL]. StudeeHelpers will attempt good-faith resolution. A consumer may use any regulator, ombud, tribunal or court available by law. Any agreed mediation or arbitration is optional for consumers where mandatory law requires that choice. South African law applies, and jurisdiction provisions may not deprive consumers or workers of a forum they are legally entitled to use.
12 Changes and notices
Material changes require reasonable advance notice and fresh affirmative acceptance where they materially affect price, liability, privacy, worker rights or dispute procedures. Archived versions and acceptance evidence must remain available.
