1 Purpose and legal status

This Agreement governs access by an approved helper to booking opportunities. The intended model is [INSERT APPROVED MODEL: independent service provider marketplace, agency worker, employee, or hybrid by service]. The parties acknowledge that legal status is determined by the true relationship and applicable law, not by the contract label. If StudeeHelpers exercises control or the law treats the helper as an employee or temporary employment service worker, all mandatory labour, UIF, COIDA, wage, leave and dismissal rights apply despite inconsistent wording.

2 Eligibility and verification

  • Provide genuine identity, work eligibility, tax, banking, qualification and reference information and consent to proportionate verification.
  • Maintain required licences, training and documents and report expiry, suspension, criminal charge relevant to safety, or material change, subject to lawful and fair process.
  • Perform only services for which the platform shows approved status. Childcare and specialist tasks require service-specific approval.

3 Opportunities acceptance and independence

Unless the approved employment model states otherwise, a helper may set availability, service radius and whether to accept an offered booking, without penalty for declining individual offers. The offer must show the service, general zone, time, estimated travel, scope and exact gross helper earnings. Once accepted, the helper must honour the booking or use the cancellation process. The platform must not impose hidden unpaid work.

4 Service standards

  • Arrive on time, verify the booking PIN, perform the agreed scope with reasonable care and skill, and follow lawful safety instructions.
  • Respect privacy, property, children, pets and household rules. Do not photograph, record or disclose household information except through an authorised incident process.
  • Do not smoke, use alcohol or impairing substances, bring unauthorised persons, accept cash outside policy, solicit clients improperly, discriminate, harass or misuse access credentials.
  • Report hazards, injury, safeguarding concerns, damage and incidents promptly. A helper may stop unsafe work and contact support without retaliation.

5 Earnings travel and deductions

The platform displays gross earnings, travel allowance, approved additions, statutory deductions if any, platform charges if any, payout timing and status before acceptance. No deduction may be made contrary to law. Tips belong to the helper subject only to unavoidable payment reversal or tax treatment. Minimum wages and statutory entitlements apply where the helper is an employee or otherwise protected.

6 Equipment and expenses

The booking states who supplies products and equipment. A helper is not required to advance material expense unless expressly accepted and reimbursed. Personal smartphone, data and travel requirements must be disclosed during onboarding. Protective equipment responsibilities depend on risk assessment and employment status.

7 Substitution and delegation

No unauthorised person may perform a booking. If lawful substitution forms part of the approved independent model, any substitute must be independently verified and accepted through the platform before receiving customer information. Childcare may never be delegated informally.

8 Confidentiality and information security

Customer addresses, contact details, access codes, family, child, pet, security and booking information are confidential and may be used only for the booking. Delete local copies when no longer required and immediately report loss or compromise.

9 Ratings fairness and account action

Ratings may inform matching but must not be the sole basis for serious adverse action. Helpers must receive notice of material allegations and a reasonable opportunity to respond, unless temporary restriction is urgently required for safety or law. Discrimination, retaliation and automated unfair deactivation are prohibited. Any employment-related discipline must follow applicable labour law.

10 Taxes insurance and statutory registration

Responsibility for tax, UIF, COIDA and insurance depends on the approved legal model and law. StudeeHelpers will not transfer a statutory employer obligation by contract. Independent helpers remain responsible for obligations legally applicable to genuine independent businesses. The platform must provide records reasonably needed for tax and earnings verification.

11 Non solicitation and client relationships

The helper may not use platform-derived confidential information to divert active bookings or commit fraud. Any post-introduction restriction must be narrow, reasonable and attorney-approved and may not unlawfully restrain trade or restrict worker mobility.

12 Term suspension and disputes

Either party may end platform participation on reasonable notice, subject to accepted bookings and mandatory rights. Immediate temporary suspension may occur for credible urgent safety or fraud concerns, followed by review. Employees retain statutory dismissal and dispute rights. Other disputes follow the fair complaint process and do not remove access to the CCMA, regulators, ombuds or courts where available.
